Gender equality is one of the key indicators for assessing a nation’s development. In order to achieve this goal, ensuring gender equality in the law-making process plays a crucial role in formulating high-quality legal policies that effectively promote gender equality in practice. However, ensuring gender equality in law-making has not yet been substantively implemented, leading to the promulgation of certain legal policies and provisions that do not fully ensure gender equality. By clarifying the concept of ensuring gender equality in law-making, identifying the fundamental components of gender equality assurance in the legislative process, analysing the challenges arising from the practical implementation of this process, the article provides a theoretical foundation for developing a set of criteria to assess the extent to which gender equality is ensured in law-making in Vietnam.
