This article examines the relationship between the protection of personal data and the professional duty of confidentiality imposed on lawyers in the context of an increasing emphasis on clients’ rights to privacy. The objective of this article is to identify the role and limitations of lawyers’ confidentiality obligations in safeguarding clients’ personal data, thereby clarifying the areas of convergence and conflict between these two legal frameworks. Based on an analysis of relevant legal provisions in the United States and Australia concerning the confidentiality of lawyer-client communications, particularly those related to personal data protection, the article draws several comparative insights of referential value and proposes a number of recommendations to improve Vietnamese law in a manner that both ensures the effective protection of clients’ personal data and maintains a proper balance with the professional functions and responsibilities of lawyers in their relationship with clients.
