The 2013 Constitution, amended in 2025, defines land as a special national resource, an important asset for the country's economic development that belongs to the people, and collectively managed by the State as a representative of the owner (articles 53 and 54). However, until now, the Constitution does not have basic provisions on the rights of land use rights owners, and still has not established principles for the effective management of land resources to limit disagreements, disputes, complaints, and lawsuits. Based on the requirements for improving the effectiveness and efficiency of land use rights management laid out in Resolution 18-NQ/TW and documents on the requirements for amending and supplementing the Constitution, this article makes some recommendations to improve the constitutional basis for land as stipulated in Articles 53 and 54 of the 2013 Constitution, amended in 2025, contributing to the country's economic development in the era of growth.
