Evidence Determination Under the Provisions of the Current Vietnamese Civil Procedure Code and Proposals for Improvement

Evidences play an important role in deciding whether a court can rule on a civil case in a lawful and objective manner. Thus, evidence determination is essential to civil procedures as it create the legal foundation for courts’ rulings. Evidence can only be determined from the source of evidence. The article analyses and evaluates the provisions of the current Vietnamese Civil Procedure Code on evidence determination, highlighting a number of existing issues, and proposes several solutions to improve the provisions of the Vietnamese Civil Procedure Code concerning evidence determination.
