Digital Transformation in International Trade and the Adaptation of Public International Trade Law

Abstract: 

As international commerce profoundly changes under the influence of digital transformation, the article aims to identify the core features of digital transformation in international trade and to examine how public international trade law has adapted to these developments. The findings are as follows: first, digital technologies such as cloud computing, big data, the Internet of Things, and artificial intelligence now form the basis of modern commerce; second, the rapid growth of digital intermediary platforms, together with the central role of data, is fundamentally altering the conduct of international trade and raises new legal questions about privacy, jurisdiction and data security; third, as far as public international trade law is concerned, the WTO system has shown clear limits in dealing with trade issues linked to digital transformation; and fourth, bilateral and regional agreements, among them the CPTPP, the USMCA and the RCEP, along with a new generation of digital economy agreements, are putting forward competing legal models to adapt to digital transformation in international trade.
