On the Basis of Criminal Liability

Abstract: 

Criminal liability is an effective measure applied by the state to individuals or commercial legal entities that commit crimes, with the aim of maintaining social order and safety and protecting justice. To ensure that criminal liability is imposed correctly on offenders and to minimise possible errors, it is essential that law enforcers possess thorough knowledge and a deep understanding of criminal law, including the basis of criminal liability. This article clarifies the concept of the basis of criminal liability, identifies its nature from different perspectives (scientific, practical, and legal), and analyses the basis of criminal liability as a criterion for determining the boundary between administrative and criminal violations.
