Non-renewable Energy and International Investment Disputes: Analysis From a Sustainable Development Perspective

Abstract: 

As non-renewable energy is one of the main causes of climate change, countries want to reduce its use and replace it with renewable energy. Nevertheless, in conducting reduction measures, host states have faced investor-state disputes. The article analyses non-renewable energy-related disputes, arguing that international investment agreements should be amended to protect investments but also must consider the sustainable development goals of countries. It also suggests that dispute settlement bodies consider the context and objectives of the measures instead of solely protecting the rights of investors.
